Instructions on the right of withdrawal for Austrian consumers:

If the customer is a consumer, he has the right to withdraw from a distance contract without giving reasons (§ 5e KSchG). To do this, the customer must declare their withdrawal within seven working days of receipt of the goods. Saturday does not count as a working day. To meet the deadline, it is sufficient for the cancellation to be sent within the deadline.

Consumers are entitled to a right of withdrawal according to the following stipulations, whereby a consumer is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their self-employed professional activity:

Right of withdrawal

To exercise your right of withdrawal, you must inform us, Sportalm GmbH, St. Johannerstrasse 73, A-6370 Kitzbühel, Austria, Email: service@sportalm.at Tel: +43 (0) 5356/64361-0, Fax: +43 ( 0) 5356/64361-133, by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also not before we have fulfilled our information obligations in accordance with Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB as well as our obligations according to § 312g paragraph 1 sentence 1 BGB in connection with Article 246 § 3 EGBGB. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline. The revocation must be sent to:

Parcels are returned in the Netherlands via Post NL.

Enter the goods and the reason for the return in the return slip! Sign the bill. For a free and uncomplicated return within Austria and from Germany as well as the Netherlands, we ask you to announce your return to Sportalm by revocation (e-mail - service@sportalm.at). Take the parcel to the nearest DHL parcel shop in the Netherlands, where your return parcel will be sent back to Kitzbühel/Austria. If the goods are returned freight collect without a return slip, we are entitled to withhold or invoice a corresponding amount. When returning your items, please ensure that all barcodes (regarding outgoing items) have been made unrecognizable before you hand over your item to DHL (Germany/Netherlands) or Österreichische Post (Austria) for return transport.

In the case of a return, we ask you to observe the following: Sending a clear statement of cancellation of the order Right of return within 14 days of delivery. Returned items must be unwashed, unworn and in perfect condition. The labels attached by Sportalm must not have been removed. When returning multiple items, the return must be made in a single shipment. The original packaging (box plus corrugated cardboard) from Sportalm must be used for your return. The return slip (included in your package) must be filled out completely. Take the package to your nearest post office in Austria and to the nearest DHL office in Germany/Netherlands where you can post the package free of charge.

Consequences of revocation

In the event of an effective revocation, the services received by both parties are to be returned and any benefits (e.g. interest) surrendered. If you cannot return or hand over the received service and benefits (e.g. advantages of use) or only partially or only in a deteriorated condition, you must compensate us for the value in this respect. You only have to pay compensation for the deterioration of the item and for any use made if the use or deterioration is due to handling of the item that goes beyond the examination of the properties and functionality. "Checking the properties and functionality" means testing and trying out the respective goods, as is possible and customary in a retail store. The return of the goods is free of charge for you via our shipping partner Österreichische Post in Austria and DHL in Germany and the Netherlands. The customer as the sender (in the case of a return) is insured with DHL if the package is lost and can therefore report the loss directly to DHL. If you send the package back via a shipping method of your choice, we can no longer assume any liability for the loss of the package.

Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the item, for us with their receipt.
